July 18, 2016; Pontiac, Michigan, Oakland County Circuit Court.
The jury awarded $186,000 in favor of a neurosurgeon and MRI facility, seeking reimbursement for medical care rendered to the PIP-insured. The award included statutory no-fault interest for over-due payments as well as double damages under the federal Medicare Secondary Payor act.
March 20: Pontiac, Michigan, Oakland County Circuit Court
The jury awarded $3,717,000 in favor of a disabled client who lost his job, his livelihood and suffered a traumatic brain injury in a low impact collision. Attorney Schefman first enforced the client’s no-fault insurance and forced it into settlement with overwhelming medical evidence. The third-party defendant had to be taken to trial, and the jury returned the verdict $3,717,000.
Claim Settled For
A client who lost her husband in a tragic automobile injury stated that she was “grateful to for all of the help of Mr. Schefman, who believed in the case, even though my husband made some deadly mistakes.” The case was settled shortly after the local mediation process required through the Circuit courts.
Precedent-Setting Decision Helps Firm Collect Millions Of Dollars For Clients
Attorney Bryan L. Schefman won a precedent-setting decision in the United States Sixth Circuit Court of Appeals (Case No. 13-2430, Decided July 16, 2014). The ruling gave medical providers the right to pursue a private cause of action under federal Medicare law from a responsible primary plan, such as a no-fault carrier, including double damages. This case has helped Schefman & Associates collect millions of dollars for our clients.
